These Terms of Service apply to purchases and use of cansurossi.com. By placing an order, you agree to these Terms together with the policies linked on this website. Nothing in these Terms limits rights that cannot lawfully be excluded under applicable consumer law.

2. Products

The store offers original artworks, fine-art prints and commissioned artworks. We aim to describe and photograph products accurately. Colours may appear slightly different depending on screen settings and lighting. Original artworks are unique works; standard prints reproduce the artwork described on the relevant product page.

3. Prices and Payment

The price payable is the price shown during checkout at the time the order is placed, together with any additional charges displayed before purchase. Payment is processed through the payment methods made available at checkout.

4. Orders

After you place an order, you will receive an electronic confirmation. If an order cannot be fulfilled because of an error, product unavailability or another legitimate reason, we will contact you and refund any amount paid for the affected item.

5. Commissions

Commissioned artworks are created to the customer's specifications. The subject, size, price, timing and other material details will be agreed before the commission proceeds. Because commissions are made to individual specifications or are clearly personalized, the statutory change-of-mind withdrawal right may not apply to them. This does not affect rights relating to faulty, damaged or non-conforming goods.

6. Shipping and Delivery

Processing and estimated delivery times are set out on our Shipping page. Delivery times are estimates and can be affected by carrier delays, customs processing or circumstances outside our reasonable control.

For consumer orders, risk of loss or damage remains with us until you, or a third party you designate other than the carrier, takes physical possession of the goods, except where you independently commission a carrier not offered by us, in which case applicable consumer law governs the transfer of risk.

7. Returns and Right of Withdrawal

8. Legal Guarantee of Conformity

Consumers have the mandatory legal guarantee and remedies provided by applicable consumer law for goods that are faulty or do not conform to the contract. For consumers in the European Union, this includes the statutory minimum two-year legal guarantee for consumer goods. These rights are separate from and are not limited by our change-of-mind return policy.

9. Intellectual Property

Unless expressly agreed otherwise in writing, purchasing an original artwork, print or commissioned physical artwork transfers ownership of the physical item only. Copyright and other intellectual-property rights in the artwork remain with Cansu Rossi. The purchase does not grant a right to reproduce, commercially exploit, distribute, license, create merchandise from, or otherwise use the artwork beyond the rights permitted by law.

10. Website Content

Website text, images, artwork photographs, graphics and other original content are protected by applicable intellectual-property law. They may not be copied or commercially used without permission except where permitted by law.

11. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, or limits mandatory consumer rights. To the extent permitted by law, we are not responsible for losses caused solely by circumstances outside our reasonable control or by misuse of a product contrary to its intended nature.

12. Privacy

Personal data is handled as described in our Privacy Policy.

13. Governing Law and Consumer Rights

These Terms are governed by Italian law. If you are a consumer, this choice does not deprive you of mandatory protections granted by the law of your country of residence where those protections apply. Any rules on consumer jurisdiction that cannot lawfully be excluded remain unaffected.

14. Changes to These Terms

We may update these Terms from time to time. The version that applies to an order is the version made available when that order is placed, except where a change is required by law.
